APPEALS TO THE OFFICE OF STUDENT AFFAIRS & ENROLLMENT MANAGEMENT OF A TEMPORARY JUDICIAL SANCTION

I. Appeal Process

Requests for an administrative review of a temporary sanction must be made to the Office of the Vice President for Student Affairs & Enrollment Management, Altgeld 210, in writing within TWO (2) CLASS DAYS of the sanction's being levied and shall set forth the grounds for appeal. Temporary sanctions remain in effect during this process. (The Student Judicial Code provides that, if the sanction was given by the Assistant Vice President for Student Services, the administrative review shall be by the President or her/his designee.)

II. The Administrative Review

The administrative review will normally be held within two class days of receipt of the request for appeal and will be conducted by the Assistant Vice President for Student Services. The purpose of the review is to determine the continuing appropriateness of the temporary sanctions imposed. No judgment of innocence or guilt will be made on the charges. Innocence or guilt will be decided through a subsequent student judicial process.

The student will be given the opportunity to present and justify her/his grounds for appeal. The Assistant Vice President for Student Services may then ask questions regarding the situation. As in other cases which are processed through the student judicial system, the student may be accompanied by an advocate or by an attorney whose role shall be confined to observing the administrative review and being available for consultation with the student.

III. Rendering of the Decision

The Assistant Vice President for Student Services will issue a decision in writing, normally within two (2) class days of the completion of the administrative review. The decision will be to sustain, lessen (but not increase), or remove the sanctions and will be based on the material from the review and other germane information (e.g. the student's judicial file). The decision is not appealable.
