APPEALS TO THE OFFICE OF STUDENT AFFAIRS & ENROLLMENT MANAGEMENT FOR SANCTIONS OF SUSPENSION OR EXPULSION

From the Northern Illinois University Student Code of Conduct, effective October 7, 2013

Appeal of University Suspension, University Expulsion, or Withholding of a Degree

a.   If an Appeal Board upholds the sanction of University Suspension, University Expulsion, or Withholding of a Degree, the Accused Student shall have the right to submit a written request for an appeal of the sanction(s) to the Vice President for Student Affairs & Enrollment Management within two (2) business days from the date the decision notice is delivered to the Student's mailbox or e-mail account (documentation for proof of delivery is required). The decision of the Vice President for Student Affairs & Enrollment Management or designee shall be final.

b.  For cases involving alleged sexual misconduct, the Accused Student and the Victim/Survivor shall both have the right to submit an appeal request within five (5) business days of the date the decision notice is delivered to the Student's mailbox or e-mail account (documentation for proof of delivery is required). The appeal must be in writing and delivered to the Office of the Vice-President for Student Affairs & Enrollment Management. The written appeal request must include what is being appealed (decision and/or sanctions). Additionally, the written appeal request must include the reasons for the appeal.

Vice Presidential Appeals Limitations

The Office of the Vice President for Student Affairs & Enrollment Management or designee will limit the appeals decision to the following questions:

1)   Did the Student Conduct Board or Administrative Hearing Officer follow proper procedure (as outlined in the Student Code of Conduct)?

2)   Is there evidence of inappropriate bias in the decision reached by the Student Conduct Board or Administrative Hearing Officer?

3)   Was the decision reached by the Student Conduct Board or Administrative Hearing Officer in an arbitrary or capricious manner?

4)   For cases involving sexual misconduct, the Vice President for Student Affairs & Enrollment Management or designee may uphold, modify, or reverse the decision or sanction(s) imposed by a Student Conduct Board or Administrative Hearing Officer.
